TERMS OF USE

Welcome to MexicoAdventourist.com®, from now named “the website”. The access and use of “the website” is conditioned to the terms of use and policies accepted by the clients and/or users, who from the moment that access, use, visit, reserve or put in contact with “the website”, accept the next conditions. Please, read carefully the described agreement between “the website” and the client and/or user.

Content
“The website” content, such as text, images, information, audio and video are “the website” property. The name and logo of MexicoAdventourist.com® are trademarks and have copyrights. Any other company name or products that appear in “the website” may be trademarks by their respective owners.

The images and/or photos published in “the website” are only representatives and not guarantee that exist a resemblance and/or accuracy between them and the places to visit. The services description, inclusions and/or exclusions, such as the prices and/or fares published in “the website”, are susceptible of modifications without previous notice.

“The website” content could not be used by other person or company with commercial purposes; if someone does, it will be abide by the Mexican legislation.

Reservations
MexicoAdventourist.com® only works together with selected tourist suppliers that carry out the Mexican legislation and protect the physic and moral integrity of the clients and/or users.

The reservation requests are subject to the service suppliers’ availability. Once you reserve, a website representative will contact you to mention you if the service contracted is available in the date and time you chose. If is available, the services payment will be able through the different options that “the website” offers.

Investment & Payments
The published prices in “the website” could be expressed in Mexican Pesos (M.N.) or American Dollars (USD). All the payments and/or charges through credit card, bank deposit, wire transfers or any other method of payment, will be process in Mexican Pesos, including the expressed in American Dollars that are subject to the bank exchange rate.

For the payments with credit card “the website” only accepts Visa™ & MasterCard™. When the client and/or user reserve through “the website”, select credit card as method of payment and provide its credit card information, is accepting the charge to the credit card. In case the client and/or user want to pay the services through credit card and do not want to provide the credit card information through the fields located in “the website”, a website representative will send to the client and/or user a credit card authorization form that have to be fill it out and send it to a website representative by fax or email. “The website” only applies credit card charge if the services requested by the client and/or user are available in the date and time. Otherwise, “the website” will let know to the client and/or user. The charges through credit cards are subject to the bank commission that will be paid by the client and/or user. By the clients´ and/or users´ safety, “the website” does not apply charges to credit cards by telephone calls. The reservations made by credit card as method of payment have to be under the cardholder´s name. Other methods of payment are available at the moment to reserve, check the best way for you.

All payments will be done in an exhibition, except if “the website” makes a promotion in deferred payments. The client and/or user commits to pay the total amount for the reserved services in the deadline agreed. Once “the website” receives the total payment for the contracted services by the client and/or user, “the website” commits to send an electronic confirmation service coupon that the client and/or user have to present to the service supplier in the activity check in.

Taxes & Additional Fees
All the published service prices in “the website” include the Value Added Tax (VAT) – IVA Impuesto Al Valor Agregado in Spanish-, except the ground transportation services that are non-taxable.

The published service prices in “the website” only cover the agreed in the inclusions description of each activity.  The additional fees described in the services will have an extra charge that have to be paid directly to the service supplier, such as the Marine National Park fee; the use pier fee; the transportation in some activities; the warranty deposits for snorkeling equipments, towels or lockers; gratuities or other type of personal service charges. The additional fees that the service supplier collects will not be imputed to “the website” and the client and/or user will have to cover them.

Changes, Cancellations & Refunds
The change dates for the activities reserved and/or paid are allowed, without additional charge, with more than 72 hours in advance to the service date, subject to the availability of the service suppliers´ date and timetable.

The change dates for the activities reserved and/or paid between 72 and 24 hours in advance to the service date, will have an administrative fee of 10% over the reserve services total amount, subject to the availability of the service suppliers´ date and timetable.

The change dates for the activities reserved and/or paid with less than 24 hours in advance to the service date are not allowed. “The website” declines any responsibility if the client and/or user decide do not do the paid activity, as well it is not committed to refund any payment for the client and/or user.
 
The client and/or user cancellations request, with 120 hours in advance to the service date, will have an administrative fee of 20% over the cancelled services total payment.

The client and/or user cancellations request, between 120 and 72 hours in advance to the service date, will have an administrative fee of 75% over the cancelled services total payment.

The client and/or user cancellations request, with less than 72 hours in advance to the service date, will have an administrative fee of 100% over the cancelled services total payment. For the mentioned reason the payment will not be refundable neither transferable to a third person.

“The website” does not accept changes from a service to other one, that is, the changes are only allowed for the same service. If the client and/or user want to change a service to other one, that will apply a cancellation policy plus a new reservation request. The paid and confirmed reservations are not transferable to a third person and do not accept name changes.  

The total refunds for the clients and/or users, without administrative fees, only apply in accordance with the next points:

1. When the service suppliers cancel the activity for reasons beyond the reasonable control or unforeseen circumstances, both of them unconnected with “the website” and
2. By illness of the client and/or user, as long as present a medical certificate or prescription to a website representative.

The client and/or user commit and accept to pay the administrative fees generated by the changed and cancelled reservations. “The website” commits to refund to the client and/or user according with the cancellation policies.

IMPORTANT REMARK. The only services that, once reserved, paid and confirmed, are non-refundable in case the client and/or user request a cancellation of them, are the swim with dolphins in any of their programs and playing Golf in any of the published Golf Courses in “the website”. If the client and/or user do not go or do not be on time in the meeting place to take the paid services, will be considered as a 100% no show charge to the client and/or user and non-imputed to “the website”.

Limited Liability
“The website” acts as a middle-agency between the client and/user and the service supplier published in “the website”. MexicoAdventourist.com® declines and/or refuses all liability with the client and/or user for any action or omission in regard to the service supplier, as well for any contingency, eventuality, delay, irregularity, accident, imprudent and/or accidental fatalities and/or death, hurt or physic and/or moral harm or damage that the service supplier cause to the client and/or user.
 
MexicoAdventourist.com® keeps the right to admit or reject, at any time, to any client and/or user in accordance with their moral behavior when they use “the website”. “The website” moral behavior does not allow to the client and/or user to send and/or transmit illegal acts, threats, insults, defamation, obscenities, offences, pornography and/or explicit sex.

If the client and/or user use the MexicoAdventourist.com® services, it means that have read, understood and accepted the aforementioned terms of use. Otherwise, the client and/or user have not to use “the website” services, nor provide any type of information. MexicoAdventourist.com® reserves the rights to change and/or modify, at any time, the above described terms or use. Any right non-aforementioned in “the website” is reserved.
